Morganwell is a service operated by ARC LABS AS, a company registered in Norway (organisation number 937 980 884), Nordahl Bruns gate 22C, 0165 Oslo, Norway (“Morganwell”, “we”, “us”). These terms are a binding agreement between you and ARC LABS AS for your use of morganwell.com, our emails and anything you buy from us. By using the site, creating an account or buying a report, you accept them. If you do not accept them, do not use Morganwell. You must be at least 18 years old to buy a report.
Both are produced automatically from public data. We may change, suspend or stop any part of the service at any time, including which areas and tax years are covered, without liability to you. This does not take away access to a report you have already paid for.
Morganwell is not a law firm and does not provide legal advice. We are not appraisers, tax advisers or accountants. We are not a government office and are not affiliated with, endorsed by or acting for any assessor, board of review, property tax appeal board, county, state or other public body. Nothing on the site, in our emails or in a report is legal, tax, financial or valuation advice, and using Morganwell does not create an attorney-client, fiduciary or other advisory relationship. We do not represent you before any body. You file your appeal yourself, on your own behalf, as your own pro se representative. If you want advice, consult a qualified professional.
Reports are compilations of public records, such as assessor data and comparable-sale records, organized to support an appeal you file yourself. They are not appraisals and are not prepared or certified by a licensed appraiser. Any value, assessment, saving or deadline shown on Morganwell is an estimate or summary produced by formula, not an opinion of value or a statement of official fact.
Our results depend on public records and other third-party data, such as property characteristics, sales and tax rates, which can be incomplete, out of date or wrong. Comparable homes are chosen by formula and cannot reflect every feature of a home. We do not check every record by hand and do not guarantee that any information is accurate, complete or current. Before you file, review the report, check the facts about your own home, and correct or leave out anything that is wrong.
Every appeal is decided by the relevant public body, not by Morganwell. We make no promise, warranty or representation that your appeal will be accepted or succeed, or that it will reduce your assessment or tax bill. An appeal can also leave your assessment unchanged. Past results, examples and estimates are not a prediction of your result.
You decide whether to appeal, and you rely on Morganwell at your own risk. You are responsible for filing on time, for the evidence you choose to submit and for the accuracy of everything you file. Deadlines shown on Morganwell and in our emails are a convenience only: the official dates are the ones published by the public body that hears your appeal, so confirm them there. Reminder emails can be late or fail to arrive, so do not rely on them.
You agree not to copy, scrape, resell or republish the service or its reports, not to access it by automated means, not to reverse engineer it, not to interfere with its operation or security, not to give false information, and not to use it for any unlawful purpose.
You sign in with a one-time code or link sent to your email, or with Google. Keep access to your email account secure. You are responsible for activity under your Morganwell account. We may suspend or close an account, or refuse service, if we reasonably believe these terms have been broken or the service is being misused.
Prices are in US dollars, shown before you pay, and charged once. There is no subscription and no share of any savings. Payments are processed by Stripe. Each report covers one parcel and one tax year. Any taxes, bank or currency fees charged by your card provider are your responsibility. We may change prices at any time; a change does not affect an order already paid.
A report is digital content that we deliver online as soon as your payment goes through. Before you pay, you ask us to start delivery immediately and acknowledge that your right of withdrawal (the right to cancel a distance purchase) ends once delivery has begun. Your order email confirms this.
Once a report has been delivered, there are no refunds for a change of mind, for the outcome of an appeal, for an appeal you decide not to file or file late, or for differences of opinion about the comparable homes chosen.
If a report is not delivered, or has a material defect (for example, it is for the wrong parcel or cannot be opened), tell us at info@morganwell.com within 14 days. Our only obligation is then to fix or deliver it again, and if we cannot do that within a reasonable time, to refund what you paid for that report. Do not start a chargeback before contacting us; we may suspend an account while a chargeback is open. This section does not limit any right you have by law that cannot be excluded.
The site, software, methods, formulas, text, design and report layout belong to ARC LABS AS or its licensors. The underlying public records do not. When you get a report, you receive a personal, non-exclusive, non-transferable, revocable right to use it to prepare and file appeals for that property, including submitting it to the public body that hears your appeal and sharing it with co-owners or someone helping you. You may not resell or publish it, or use it to build a competing service. If you send us feedback or ideas, we may use them freely without paying you.
Morganwell relies on third parties, such as public record sources, payment, email, hosting and sign-in providers. We are not responsible for their services, websites, errors or outages, and links to other websites are provided for convenience only.
To the fullest extent permitted by applicable law:
These limits do not apply to liability that cannot be limited or excluded by law, such as liability for intent or gross negligence, or for death or personal injury caused by negligence. Where the law does not allow a limit in full, it applies to the greatest extent the law allows.
To the extent permitted by law, you will compensate and hold harmless ARC LABS AS and its owners, directors, employees and contractors from claims, losses and reasonable costs, including legal fees, brought by third parties and arising from your breach of these terms, your misuse of the service or anything you file or publish.
We are not responsible for delay or failure caused by events beyond our reasonable control, such as outages of hosting, payment or email providers, changes in or unavailability of public records, internet failures, cyberattacks, government action or natural events.
We may update these terms at any time by publishing a new version here. The version in force when you buy a report applies to that purchase. If you keep using Morganwell after a change is published, the updated terms apply to that use.
If something goes wrong, email info@morganwell.com and describe the problem before starting any legal claim. We will try to resolve it within 30 days. This does not affect any right you have by law to complain to a consumer authority.
These terms, and any dispute or claim arising out of or in connection with them or your use of Morganwell, including non-contractual disputes, are governed exclusively by the laws of Norway, without regard to conflict-of-laws rules that would apply the law of another place. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The courts of Norway have exclusive jurisdiction, with Oslo District Court (Oslo tingrett) as the agreed venue, and you agree to submit to them. ARC LABS AS does not consent to the jurisdiction of the courts or authorities of any other country, state or county, and nothing in these terms, on the site or in our dealings with you is such a consent.
To the fullest extent permitted by law, any claim must be brought individually, not as a plaintiff or class member in a class, collective or representative action, and you waive any right to a jury trial.
If you are a consumer, this section does not take away the protection of mandatory rules of the law where you live that cannot be excluded by agreement.
If any part of these terms is held invalid or unenforceable, it is limited to the minimum extent necessary and the rest remains in full effect. These terms and our Privacy Policy are the whole agreement between you and us about Morganwell. If we do not enforce a right, we have not waived it. We may transfer this agreement to a company that takes over Morganwell; you may not transfer it without our written consent. You agree that we may give you notices and agreements electronically, by email or on the site. These terms are written in English, and the English version applies if they are translated. Sections 4 to 6 and 11 to 19 continue to apply after your use of Morganwell ends.
